Kündigung von Vermieterseite stellt die Mieterinnen und Mieter meistens vor grosse Probleme. Insbesondere in Zeiten der Wohnungsknappheit oder -not stehen die Betroffenen oft vor unüberwindbaren Hindernissen.<\/p><p>Viele Vermieter kündigen heute die Mietverhältnisse frühzeitig, das heisst unter Einhaltung einer längeren als der gesetzlich oder vertraglich vorgesehenen Kündigungsfrist. Die meisten Wohnungswechsel finden zudem nicht zu den ortsüblichen Kündigungsterminen statt. Damit die Suchenden möglichst flexibel sind, soll ihnen schon während der Kündigungsfrist dieselbe Auflösungsmöglichkeit eingeräumt werden, die das Gesetz für die Erstreckungsdauer vorsieht (Art. 272d OR).<\/p><p>Vor allem Mieterinnen und Mieter in engen finanziellen Verhältnissen können sich eine doppelte Mietzinsbelastung für einige Monate nicht leisten. Zudem entfällt im Allgemeinen bei gekündigten Mietverhältnissen die Möglichkeit, einen Nachfolgemieter gemäss Artikel 264 OR zu finden.<\/p><p>Es gilt auch zu berücksichtigen, dass beim Abschluss eines Mietvertrages teilweise sofort Depotleistungen bis zu drei Monatszinsen fällig werden, während allenfalls ein für das bisherige Mietobjekt geleistetes Depot oft noch während eines ganzen Jahres nach Beendigung des Mietverhältnisses gebunden bleibt (Art. 257e OR).<\/p><p>Die Vermieterschaft ist durch diese Flexibilisierung zugunsten der Mieterschaft letztendlich auch besser gestellt, da sich dadurch allenfalls Erstreckungsverfahren vermeiden lassen können. Während der Erstreckungsdauer gelten zudem sowieso gemäss Artikel 272d OR kürzere Kündigungsfristen zugunsten der Mieterschaft.<\/p>"},{"type":{"id":5,"name":"Eingereichter Text"},"value":"<p>Gestützt auf Artikel 160 Absatz 1 der Bundesverfassung und Artikel 21bis des Geschäftsverkehrsgesetzes reiche ich folgende Parlamentarische Initiative in der Form eines ausgearbeiteten Entwurfes ein:<\/p><p>Art. 266dbis OR<\/p><p>Kündigt der Vermieter ein Mietverhältnis von Wohnungen oder Geschäftsräumen, kann der Mieter während der Kündigungsfrist mit einer einmonatigen Frist auf Ende eines Monats kündigen.<\/p>"},{"type":{"id":1,"name":"Titel des Geschäftes"},"value":"Mietrecht.
