erlaubt die Untermiete zwar nur mit Zustimmung des Vermieters. Die Zustimmung kann allerdings nur unter bestimmten Voraussetzungen verweigert werden (Art. 262 Abs. 2 OR). Vor allem in Städten werden günstige Altbauwohnungen vielfach zu Mietzinsen untervermietet, die beträchtlich über dem vom Hauptmieter bezahlten Mietzins liegen. Die Differenz streicht der Mieter ein. Um den unrechtmässigen Ertrag noch weiter zu steigern, werden Mietobjekte teils raumweise zu haarsträubenden Preisen an mehrere einzelne Untermieter weitervermietet. Vermieter werden erst gar nicht über die Untermiete informiert oder um die Zustimmung dazu angefragt. In vielen Fällen haben Vermieter daher keine Ahnung, wer ihr Mietobjekt tatsächlich bewohnt oder nutzt.<\/p><p>Der Zweck der Untermiete liegt in der vorübergehenden Gebrauchsüberlassung, welche dem Mieter die Möglichkeit offenhalten soll, beispielsweise nach einer Abwesenheit infolge eines Auslandsaufenthalts wieder in seine Mietwohnung zurückzukehren. Die Gerichte gestehen dem Vermieter daher das Recht zu, seine Zustimmung zur Untermiete zu verweigern, wenn der Mieter keine Absicht hat, das Mietobjekt später wieder selbst zu nutzen. Der Vermieter kann eine \"ewige\" Untermiete auch mit einer Kündigung sanktionieren. Die Praxis zeigt aber leider, dass die reine Behauptung des Mieters, er werde das Mietobjekt später wieder selbst nutzen, ausreichend ist, um die Beweislast umzukehren. Denn in diesen Fällen wird vom Vermieter der Nachweis verlangt, dass der Mieter keine Rückkehrabsicht hat. Dies lässt sich jedoch schlicht nicht nachweisen. Das geltende Recht ist infolgedessen nicht praktikabel und schützt Umgehungen der gesetzgeberischen Absicht.<\/p><p>Um Missbräuche künftig zu verhindern, muss der Vermieter eine zustimmungslose Untervermietung oder eine Untermiete, welche mit einer treuwidrig erschlichenen Zustimmung erfolgt, in der Praxis wirksam sanktionieren können. Zu diesem Zweck hat das Gesetz die Anforderungen an die Berechtigung zur Untermiete klar festzulegen und bei Gesetzesverstössen des Mieters ein ausserordentliches Kündigungsrecht des Vermieters vorzusehen.&nbsp;<\/p>"},{"type":{"id":5,"name":"Eingereichter Text"},"value":"<p>Gestützt auf Artikel 160 Absatz 1 der Bundesverfassung und Artikel 107 des Parlamentsgesetzes reiche ich folgende parlamentarische Initiative ein:<\/p><p>Artikel 262 OR ist wie folgt anzupassen bzw. zu ergänzen:<\/p><p>Art. 262<\/p><p>Abs. 1<\/p><p>Der Mieter kann die Sache nur mit schriftlicher Zustimmung des Vermieters ganz oder teilweise untervermieten.<\/p><p>Abs. 2<\/p><p>Der Mieter muss ein Untermietbegehren schriftlich beim Vermieter stellen; das Begehren muss enthalten:<\/p><p>Bst. a<\/p><p>die Namen der Untermieter;<\/p><p>Bst. b<\/p><p>die Vertragsbedingungen, insbesondere das Untermietobjekt, den Gebrauchszweck, den Untermietzins, die Vertragsdauer.<\/p><p>Über Änderungen dieser Angaben während der Untermietdauer hat der Mieter den Vermieter zu informieren.<\/p><p>Abs. 3<\/p><p>Der Vermieter kann die Zustimmung insbesondere verweigern, wenn:<\/p><p>Bst. a<\/p><p>der Mieter sich weigert, die Bedingungen gemäss Absatz 2 bekanntzugeben;<\/p><p>Bst. b<\/p><p>die Bedingungen der Untermiete im Vergleich zu denjenigen des Hauptmietvertrags missbräuchlich sind;<\/p><p>Bst. c<\/p><p>dem Vermieter aus der Untermiete wesentliche Nachteile entstehen;<\/p><p>Bst. d<\/p><p>eine Untermietdauer von mehr als zwei Jahren vorgesehen ist.<\/p><p>Abs. 4<\/p><p>Unverändert gemäss geltendem Absatz 3<\/p><p>Abs. 5<\/p><p>Erfolgt die Untermiete ohne schriftliche Zustimmung des Vermieters, hat der Mieter falsche Angaben gemacht oder den Vermieter über Änderungen nicht informiert (Abs. 2), so kann der Vermieter nach erfolgloser schriftlicher Mahnung mit einer Kündigungsfrist von mindestens 30 Tagen kündigen.<\/p>"},{"type":{"id":1,"name":"Titel des Geschäftes"},"value":"Missbräuchliche Untermiete vermeiden"}],"title":"Missbräuchliche Untermiete vermeiden"}
